1. THE PARTIES TO THIS AGREEMENT

The Renter: As per the booking agreement

The Owner: Shamrock Car Hire SL, Calle Alemania 49, Hacienda del Alamo, Fuente Alamo, 30320, Murcia, Spain

2. THE OBJECT OF THE RENTAL

Vehicle Details: The vehicle is allocated following receipt of the booking.

The Owner states that to the best of his knowledge and belief the vehicle is in sound and safe condition and free of any known defects or faults which would affect its safe operation under normal use. Video will be taken to record the condition of the vehicle.

3. RENTAL PERIOD

The Owner agrees to rent the vehicle to the Renter as per the rental agreement.

4. RENTAL RATE AND DEPOSIT

The Renter agrees to pay the owner at the agreed rate of the booking.

The Renter further agrees to make a deposit of €250 with the Owner, said deposit to be used, in the event of loss of or damage to the vehicle or equipment during the term of this Car Rental Agreement, to defray fully or partially the cost of necessary repairs or replacement. In the absence of damage or loss, said deposit shall be credited toward payment of the Rental Rate and any excess shall be returned to the Renter.

The deposit amount will cover insurance excess in case of any insurance claims which may arise during the rental period.

5. QUALIFICATION DOCUMENTS REQUIRED

  • The Renter states that he/she is physically and legally qualified to operate the above-described vehicle.
  • The Renter is between 25 and 65 years of age.
  • The Renter does not have any points on their driving license and holds a driving license for 3 or more years from the date of hire.
  • To drive the vehicle mentioned in paragraph 2.1, the Renter must provide at the time of hire an original full driving license, passport, and rental agreement.

6. USE OF THE VEHICLE

  • The vehicle hired shall be the sole responsibility of the Renter for the duration of the rental period.
  • Only those named on the rental agreement have permission to drive the vehicle.
  • It is not permitted to use the vehicle to transport goods, pets, or more passengers than legally allowed.
  • No smoking or modifications of the vehicle are permitted.
  • The Owner is not responsible for personal belongings left in the car.
  • The vehicle shall not be used for hire, towing, racing, illegal purposes, or by any other driver without written permission.
  • The vehicle cannot be taken out of mainland Spain.
  • The Renter is fully responsible for the vehicle if any terms are breached.

7. FEES AND FINES

The Renter agrees to cover any fines/charges/speeding tickets incurred during the rental period, plus an additional €25 administration fee.

8. COLLISION DAMAGE WAIVER (CDW) & INSURANCE – IMPORTANT NOTICE

The rental vehicle is covered by the Owner's fleet motor insurance, which provides cover for third-party liability as required by law. This insurance does not provide personal insurance for the Renter or any additional driver and does not cover injuries to the driver or passengers, personal belongings, luggage, mobile phones, electronic devices, cash, or any other contents carried in the vehicle.

Collision Damage Waiver (CDW) insurance is NOT included in your vehicle rental and is STRONGLY RECOMMENDED. Independent CDW policies are widely available from approximately €20–€30 for a single trip or €40–€60 for an annual multi-trip policy.

By choosing NOT to purchase Collision Damage Waiver (CDW) insurance, you acknowledge and accept that you may be held financially responsible for the cost of repairing or replacing the rental vehicle, together with any insurance excess, recovery costs, loss of use (where legally recoverable), administration charges, and any other losses for which you are liable under this Rental Agreement.

By proceeding with your booking, you confirm that you have READ, UNDERSTOOD AND ACCEPTED this provision, and that you have either:

  • PURCHASED your own suitable Collision Damage Waiver (CDW) insurance; or

  • CHOSEN TO PROCEED WITHOUT such insurance, fully understanding and accepting the potential financial consequences should the rental vehicle be damaged during the rental period.

9. OTHER RESTRICTIONS & CHARGES

  • Damage to tyres or wheels is at the Renter's expense.
  • Do not remove rental agreements or official documents; replacement fee up to €100.
  • If the vehicle is not returned in reasonable condition, a full valet charge up to €100 applies, plus any additional repairs.
  • Loss of car keys: €300.
  • Loss of tools, spare tyre, emergency kits, first aid boxes will be charged.
  • Late arrivals between 01:00 - 06:00 incur a €40 fee.
  • Accident excess: €250.

10. FUEL

The vehicle is provided with a full tank and must be returned full. Missing fuel incurs the cost of refuelling plus a €25 admin fee. Wrong fuel incurs €375 plus full refuelling cost. Fuel must be refilled within 5km of return airport.

11. BREAKDOWN

In the unlikely event of a breakdown, please contact 24 hour emergency breakdown cover. Their phone number is +34 932 27 75 99 or +34 913 25 52 42. A V-16 beacon is now provided in the glove box of the car. Remove it, turn it on, place on the roof of the car and vacate to a safe place until recovery arrives. Replace the light back in the glovebox. Removal of the light from the vehicle at the end of the rental will incur a charge of €50

12. ACCIDENTS

  • Notify the Owner immediately and stay with the vehicle.
  • Take full details of all parties involved.
  • Complete the accident form in the glove box.
  • Do not admit responsibility unless certain.
  • Inform the police immediately (112).
  • Failure to comply may void insurance; excess: €250.

13. CANCELLATIONS & REFUNDS

  • €250 deposit required to confirm booking; deposit non-refundable.
  • Cancellation within 14 days before arrival: full balance charged.
  • Refunds outside these periods: 25% of booking lost; remaining credited to next booking.
  • Shortening a booking results in loss of paid days.
  • Changes or cancellations must be emailed to info@shamrockcarhire.es.
  • Full refund allowed if cancelled within 14 days from booking date.

14. PAYMENTS

Payments are made in full at time of booking. Then there is a seperate €250 deposit to be paid via credit/debit card. Prices quoted are final. Bookings are only confirmed once all payments are made.

15. GENERAL DATA PROTECTION REGULATIONS
